  • “Welcome to our website”

  • We want all our customers to come here time and time again and enjoy the contents of this website and to be ‘delighted’ with the services we offer, which we see is part of the “Pink Daisy experience”.

  • Pink Daisy Weddings offer the following services, which are bespoke to you and your wedding: Venue Search Service; Suppler Sourcing; Guest Management; On the Day co-ordination; Partial co-ordination; Full-Wedding Co-ordination, (or variances thereof), and associated products to be tailor made to your requirements.

  • “The Pink Daisy Experience” - Our Pink Daisy team prides themselves on offering you, our client, an exceptional wedding planning experience with no stress or worries to you.

  • “We’re here to help!!” – Not sure what you are looking for, or if you have a query about one of our services or even a question about wedding etiquette etc, then please email us on info@pinkdaisyweddings.co.uk and we will respond as soon as we can.

  • We welcome clients suggestions at all times, whether related to our customer service, or to give us feedback on the service we deliver.

 

 

Interpretation

 

  • In these Terms and Conditions (Terms), the following words and phrases shall have the following meanings:

    • “Client/You or Your” means the person who purchases and/or receives the Service(s) from Us;

    • “Us/We or Our” means Pink Daisy Weddings;

    • “Agreement” means the Agreement between Us and You which shall be deemed to incorporate these Terms and the terms on any individual Proposal;

    • “Service(s)” means Our Venue Search, and Supplier Sourcing services, as detailed in the Proposal to be delivered by Us To You;

    • “Materials” means any Materials supplied by Us to You as part of a Proposal;

    • “Proposal” means the completed Proposal form and Terms provided by Us and executed by You describing the Services requested by You and accepted by Us.

    • Our “Associate” or your “Wedding Co-Ordinator” means the wedding co-ordinator who is based at your wedding destination and will organise your wedding.

    • “Supplier” means any supplier of goods or services in connection with your wedding which we book on your behalf.

 

 

Amendments

 

  • We may update these terms and conditions from time to time to improve our service to you and will notify these changes to you by posting the amended terms and conditions on the website.

  • The changes will apply to all use of the website after we have posted the new terms and conditions.

  • If you continue to use the website after the date on which the change comes into effect, your use of the website will indicate your agreement to be bound by the new terms and conditions.

 

 

The Agreement

 

  • The Agreement shall be on these Terms, incorporating the terms on any Proposal, to the exclusion of all other terms and conditions. If any conflict arises between these Terms and the terms of the Proposal the terms of the Proposal shall prevail.

  • The Agreement will commence when you sign and return Your Proposal and shall terminate upon delivery of the Services or as otherwise detailed in accordance with these Terms.

 

 

The Service

 

  • We will provide the wedding and event planning Services, which may include without limit, the provision of: Venue Search Service; Suppler Sourcing; Guest Management; On the Day co-ordination;Partial co-ordination; Full-Wedding Co-ordination, (or variances thereof), and associated products, on dates and at locations as are more specifically defined and confirmed within Your Proposal.

  • Unless otherwise stipulated in Your Proposal You will be responsible for entering into contracts with suppliers directly and you will be fully responsible for the management of those contracts, even where suppliers have been recommended by us.

  • Any additional work undertaken at your request, including without limit, additional meetings and/or site visits, or as a result of delays outside our reasonable control will be separately chargeable at our then current standard rates.

     

 

Responsibilities

 

  • You are responsible for:

    • Ensuring your instructions to us are clear.

    • Notifying us of any special considerations you or your guests may have.

    • Ensuring the health, safety and welfare of any persons delivering the Services to you, where such persons are present at your sites/venue.

    • Being on time to any planned meetings or events.

    • Making any payments due to us in a timely manner.

    • Managing your budget.

    • Entering into contracts with Suppliers and ensuring you have read and understood them.

    • Executing appropriate policies of insurance, (where relevant) to cover your liabilities under this contract or otherwise.

       

  • We are responsible for:

      Delivering the Services with all reasonable skill and care, and in full compliance of relevant established current professional standards.

 

 

Authority

 

  • You hereby appoint us as agents to act on your behalf in dealing with suppliers as part of Our Services under this Agreement. In Our capacity as agents we reserve the right to make any operational changes deemed necessary and/or in your best interest.

  • Where changes result in an increase to the amount of money paid to a supplier that is in excess of 10% of the original contract value we will notify you prior to making the change.

  • We will only accept direction from the persons named in the Proposal, unless prior written approval is received instructing us to do otherwise.

 

 

Risk and Ownership of Materials.

 

  • We will retain ownership of any Materials delivered as part of the ‘For Hire’ Services. You will be responsible for ensuring that any Materials, including their packaging, supplied to you as part of the Services remain in the same condition as they are supplied to you in.

  • Risk on any Materials purchased for you by us as part of any Service shall pass to you on delivery. Ownership of the Materials shall not pass to you until we have received in full cleared funds all sums due to us in respect of the Materials and all other sums which are or may become due to us from you on any account.

  • Until ownership of the Materials has passed to You, You shall: hold the Materials on Our behalf; storing them separately from all other goods of Yours or any third party in such a way that they remain identifiable as Our property; not destroy or deface any identifying mark on the Materials or their packaging; and, maintain the Materials in satisfactory condition fully insured.

 

 

Price and Payment

 

  • The price for the Services will be set out in the Proposal and will be subject to any applicable UK taxation, including where relevant, VAT.

  • Expenses will be charged in addition to the price for the Services and may include, without limitation, mileage at the Inland Revenue’s then current rates and hotel expenses charged at cost. All expenses will be agreed prior to being incurred.

 

  • Payment is required as follows:

 

Venue Search Service:

A 50% deposit is taken with your Order. The remaining fees will be invoiced on completion of the Services and payable within 14 days of the date of the invoice.

 

Suppler Sourcing:

A 50% deposit is taken with your Order. The remaining fees will be invoiced on completion of the Services and payable within 14 days of the date of the invoice.

 

Guest Management:

A 50% deposit is taken with your Order. The remaining fees will be invoiced on completion of the Services and payable within 14 days of the date of the invoice.

 

On the Day co-ordination:

A £500 deposit is payable with Your Order, two further stage payments of 25% will payable in accordance with the schedule detailed in Your Proposal. The final balance is payable within 14 days of your event date, unless by agreement there is a payment plan in place.

 

Partial co-ordination:

A £800 deposit is payable with Your Order, two further stage payments of 25% will payable in accordance with the schedule detailed in Your Proposal. The final balance is payable within 14 days of your event date, unless by agreement there is a payment plan in place.

 

Full-Wedding Co-ordination:

A £1,000 deposit is payable with Your Order, two further stage payments of 25% will payable in accordance with the schedule detailed in Your Proposal. The final balance is payable within 14 days of your event date, unless by agreement there is a payment plan in place.

 

For Hire Items:

A 50% deposit is taken with your Order. The remaining fees will be invoiced on completion of the Services and payable within 14 days of the date of the invoice. Loss or damage to any items will be charged at full replacement cost as outlined in your Proposal.

 

  • Payments:

    • The deposit due is non-refundable.

    • Payment is made by cheque, PayPal or bank transfer to Pink Daisy Weddings, unless otherwise advised on Your Order/Proposal. Bank details for direct bank transfers can be made available on request. Any queries relating to an invoice must be received within 7 days from the date on the invoice.

    • If payment is in arrears late payment charges will be levied on a daily basis at 8% above the then current Bank of England base-lending rate.

    • We reserve the right to levy additional charges for late payment, including an administration fee of £40 for each notice of late payment We issue to You and will take all action required to recover any sums outstanding. Invoices overdue by more than 90 days will be passed to our solicitors for recovery + costs/expenses.

    • If your full payment is not received and cleared by the agreed deadline, Pink Daisy Weddings may cancel the wedding with no refund to You, the client. If paying by cheque or bank transfer please allow 4 working days to clear.

    • In all events we will retain any deposits or retainer fees paid and any stage payments or other payments made prior to the cancellation date.

    • Our fee for weddings booked less than 12 weeks before the wedding date will be a 50% deposit of the total, or paid in full at the time of booking depending on how many weeks are left before the wedding day.

 

 

Cancellation Policy

 

  • If you have to cancel your wedding, it is your sole responsibility to notify Pink Daisy Weddings in writing. The appropriate cancellation fee will apply. Upon the proper notification and receipt of the event cancellation from you, any applicable refunds will be sent back to you via a cheque, BACS or PayPal normally within 14 working days, less banking charges.

  • In accordance with 'The Cancellation of Contracts made in a Consumer's Home or Place of Work etc Regulations 2008” We are providing you with notice of your right to cancel your agreement with Us.

  • You can exercise your right to cancel by delivering or sending (including by electronic mail) a notice of cancellation in writing to: Pink Daisy Weddings, 69 Saturn Way, Hemel Hempstead, Hertfordshire HP2 5PA or to info@pinkdaisyweddings.co.uk at any time within the period of 7 days starting on the date you receive your copy of this Agreement.

  • Your notice of cancellation is deemed to be served as soon as it is posted or the date you send your request by email. All cancellation requests must be received and agreed in writing by us.

  • Please note you may be required to pay for goods and services supplied to you by us prior to receiving your notice of cancellation if you requested in writing that these goods or services should be delivered before the end of the cancellation period.

  • If you have entered into a credit agreement with us this will automatically be cancelled when you send your notice of cancellation.

  • You are free to notify us using whatever form you wish as long as your notice is sent in accordance with the above details. Once a Proposal has been accepted and the statutory right to cancel period has expired the cancellation terms contained below apply:

  • Your Venue Search Service may be cancelled at any time. The 50% deposit is non-refundable and any work already carried prior to the receipt of the cancellation will still be charged.

  • Your Suppler Sourcing may be cancelled at any time. The 50% deposit is non-refundable and any work already carried prior to the receipt of the cancellation will still be charged.

  • Your Guest Management Service may be cancelled at any time. The 50% deposit is non-refundable and any work already carried prior to the receipt of the cancellation will still be charged.

  • Your On the Day co-ordination may be cancelled on receipt of a minimum of one months’ notice prior to the event date. The deposit is non-refundable. Any other payments made will be refunded and any work already carried prior to the receipt of the cancellation will still be charged.

  • Your Partial co-ordination may be cancelled on receipt of a minimum of one months’ notice prior to the event date. The deposit is non-refundable. Any other payments made will be refunded and any work already carried prior to the receipt of the cancellation will still be charged.

  • Your Full-Wedding Co-ordination may be cancelled on receipt of a minimum of three months’ notice prior to the event date. The deposit is non-refundable. Any other payments made will be refunded and any work already carried prior to the receipt of the cancellation will still be charged.

  • For Hire Items may be cancelled and refunded in full on receipt of a minimum of three months (or more) notice prior to the event date. Cancellations on receipt of 1-3 months’ notice will be refunded at 50% of the total hire cost and cancellations on receipt of notice 30 days and under prior to the event date are non-refundable.

 

Liability

 

  • Neither party shall be liable for any indirect or consequential losses or expenses, including but not limited to loss of or damage to anticipated profits, contracts, reputation, goodwill, labour costs or losses or expenses arising from 3rd party claims.

  • Notwithstanding the above and save in the case of death or personal injury cause caused by negligence for which the liability of the parties shall be unlimited, the parties liability under this Agreement shall be limited to the fees charged or £5000 whichever is the lesser.

  • For the avoidance of doubt We shall not be liable for any loss or damage incurred as a result of any act or omission of Yourselves, Your employees, agents, representatives, 3rd party suppliers and contactors or any persons for which You are at the relevant time responsible, including without limitation, failure to adhere to any element of advice or recommendations communicated to You, whether in writing or verbally.

 

 

General

 

  • If any part of this Agreement is found to be void or un-enforceable by any Court of competent jurisdiction, such part shall be severed from this Agreement which will otherwise remain in full force and effect.

  • These Terms shall remain in force until altered in writing and signed by both parties.

  • You may not assign this Agreement or any rights or obligations under it without our prior written consent.

  • Except where expressly specified the parties do not intend to create any rights under this agreement for 3rd parties under the Contracts (Rights of 3rd Parties) Act 1999.

  • Unless otherwise agreed and subject to the application of the then current prices, these Terms of Business shall apply to any future instructions given by you to Us. This Agreement shall be governed by the laws of England and Wales.

 

 

General Terms and Liability Limit

 

  • Neither we nor our associates shall be liable for failure to perform our services if prevented so by any cause beyond our reasonable control.

  • Anyone who is not party to this agreement shall have no right to enforce any of its terms and conditions under the Contracts (Rights of Third Parties) Act 1999.

  • You will indemnify us for any costs, claims and expenses we incur arising from any breach by you of this agreement.

  • We limit our maximum liability for any breach of this agreement, negligence or misrepresentation to the total amount of your wedding package paid to us; however, our liability for (1) death and personal injury caused by our negligence; or (2) fraudulent misrepresentation; is unlimited.

  • This full version of our terms and conditions will be sent to upon booking to read and sign before paying your deposit.

 

 

General Terms of Agreement

 

  • If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.

  • If you breach these terms and conditions and we ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the terms and conditions.

  • We will not be responsible for any breach of these terms and conditions caused by any circumstances beyond our control.

  • A Person who is not party to these terms and conditions shall have no right under the contract (Rights of Third Parties Act 1999) to enforce any of these terms and conditions, but this shall not affect any right or remedy of a Third Party which exists or is available apart from that Act.

  • These terms and conditions shall be governed by and construed in accordance with the laws of England & Wales and any disputes will be decided only by the English Courts.

  • We reserve the right to cancel, suspend or delay delivery of an order without being liable for any loss or damage if the supply of the goods is prevented or delayed for circumstances beyond our control.

  • These terms and conditions do not affect your statutory rights.

  • …for which you have not obtained all necessary licences and/or approval, or…

  • …which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise by contrary to the law infringe the rights of any third party, in any country in the world, or…

  • …which is technically harmful (including, without limitation, computer viruses).

  • You may not misuse the website (including, without limitation, by hacking).
